By purchasing or using any paid features, subscriptions, credits, or services offered through our platform, you agree to this Refund Policy.

By accessing or using SMPL Social LLC (“Company”, “we”, “our”, or “us”) and its platform, website, applications, tools, artificial intelligence systems, and services (collectively, the “Services”), you agree to be bound by these Terms and Conditions. If you do not agree to these Terms, you may not access or use the Services.

2. Digital Services and AI Generation

  1. Eligibility

SMPL Social LLC provides digital products and artificial intelligence generation services that consume computational resources immediately upon use. Due to the nature of digital and AI-powered services, all purchases are generally final and non-refundable.

This includes but is not limited to:

  • AI-generated images

  • AI-generated videos

  • Credits

  • Subscription plans

  • Usage-based billing

  • Premium features

  • Storage and processing services

You must be at least 13 years old to use the Services. By using the platform, you represent and warrant that you meet this requirement and possess the legal authority to enter into these Terms.

3. Non-Refundable Usage

  1. User Accounts

Once credits, generations, storage, processing power, or subscription benefits have been used, consumed, accessed, or partially utilized, they are non-refundable.

Completed AI generations, successful processing requests, delivered outputs, and consumed platform resources are considered fulfilled digital services.

You are responsible for maintaining the confidentiality of your account credentials and for all activity conducted through your account. SMPL Social LLC reserves the right, at our sole discretion, to suspend, restrict, terminate, or remove accounts for any reason, including but not limited to suspected abuse, fraud, excessive usage, unauthorized activity, platform exploitation, chargebacks, or violations of these Terms.

4. Subscription Cancellations

  1. AI-Generated Content

Users may cancel subscriptions at any time. Cancellation will prevent future billing cycles but does not automatically entitle users to refunds for:

  • Current billing periods

  • Previously charged subscription fees

  • Partially used subscription periods

  • Unused credits or features

Users will continue to have access to subscription benefits until the end of the active billing cycle unless otherwise determined by SMPL Social LLC.

The Services may allow users to generate images, videos, text, audio, graphics, or other content using artificial intelligence systems. You acknowledge and agree that AI-generated outputs may not be unique and that similar or identical outputs may be generated for other users.

SMPL Social LLC makes no guarantees regarding the originality, legality, reliability, accuracy, quality, ownership status, or suitability of AI-generated content. Users are solely responsible for reviewing and evaluating generated outputs before publication, commercial use, distribution, or reliance upon them.

5. Failed or Duplicate Charges

  1. Ownership, Licensing, and Data Rights

If you believe you were charged incorrectly due to a technical issue, duplicate billing, or unauthorized transaction, you may contact us for review.

SMPL Social LLC reserves the right, at our sole discretion, to determine whether a refund, partial refund, account credit, or billing adjustment is appropriate.

Users retain ownership of any original content they upload to the platform. However, by uploading, generating, submitting, processing, or interacting with content through the Services, you grant SMPL Social LLC a worldwide, perpetual, irrevocable, transferable, sublicensable, royalty-free license to use, reproduce, modify, adapt, distribute, publish, analyze, display, create derivative works from, and otherwise utilize such content for operational, commercial, research, analytical, promotional, marketing, training, and product improvement purposes.

This license includes but is not limited to use for artificial intelligence model training, machine learning improvement, algorithm development, analytics, platform optimization, advertising, demonstrations, internal testing, and future product development.

SMPL Social LLC retains all rights, title, and interest in and to the platform, software, systems, infrastructure, algorithms, branding, interfaces, models, workflows, databases, and proprietary technology associated with the Services.

6. Abuse, Fraud, and Chargebacks

  1. AI Training and Model Improvement

SMPL Social LLC reserves the right to deny refunds in cases involving:

  • Abuse of the platform

  • Excessive usage

  • Fraudulent activity

  • Chargeback abuse

  • Violations of our Terms and Conditions

  • Attempts to exploit refund systems

  • Unauthorized automation or scraping

Users who initiate fraudulent chargebacks may have their accounts suspended or permanently terminated.

You acknowledge and agree that content uploaded, generated, processed, or submitted through the Services may be used to train, fine-tune, validate, improve, benchmark, and optimize artificial intelligence and machine learning systems.

This may include combining user-generated data with aggregated datasets from other users or third-party systems. You understand that outputs generated by the Services may be influenced by large-scale datasets and may resemble or overlap with outputs generated for other users.

SMPL Social LLC does not guarantee exclusivity or uniqueness of generated outputs.

7. Service Availability

  1. Acceptable Use

Temporary outages, interruptions, delays, maintenance periods, generation failures, or third-party infrastructure issues do not automatically qualify users for refunds.

While we strive to maintain reliable platform availability, SMPL Social LLC does not guarantee uninterrupted access to the Services.

You agree not to use the Services for unlawful, harmful, fraudulent, exploitative, infringing, abusive, or unauthorized purposes. Users may not reverse engineer, scrape, benchmark, overload, exploit, interfere with, copy, replicate, or misuse the platform or its infrastructure.

You further agree not to circumvent rate limits, generation restrictions, pricing systems, subscription limitations, security measures, or platform controls. Unauthorized automation, botting, abuse of system resources, or attempts to disrupt operational stability are strictly prohibited.

SMPL Social LLC reserves the right to investigate and take enforcement action against violations at our sole discretion.

8. Billing Disputes

  1. Excessive Usage and Abuse Protection

Users agree to contact SMPL Social LLC before initiating disputes, reversals, or chargebacks with payment providers or financial institutions.

We will make reasonable efforts to review and resolve billing concerns in good faith.

SMPL Social LLC reserves the right, at our sole discretion, to limit, throttle, suspend, restrict, or terminate usage that we determine to be excessive, abusive, exploitative, financially unreasonable, automated, harmful to infrastructure stability, or inconsistent with intended platform usage.

This includes but is not limited to excessive AI generations, automated scraping, account farming, API abuse, bandwidth abuse, unauthorized scripting, or attempts to overload platform systems.

9. Modifications to This Policy

  1. User Responsibility for Generated Content

SMPL Social LLC reserves the right to modify, update, or replace this Refund Policy at any time without prior notice. Continued use of the Services after changes become effective constitutes acceptance of the updated policy.

Users are solely responsible for all prompts, uploads, generated outputs, published materials, and downstream use of content created through the Services.

SMPL Social LLC does not actively review all generated outputs and shall not be liable for how generated content is used, interpreted, distributed, modified, or commercialized by users.

Users agree not to generate, upload, publish, or distribute content that is unlawful, infringing, defamatory, misleading, malicious, harmful, abusive, fraudulent, or otherwise prohibited under applicable laws or these Terms.

  1. . Platform Monitoring and Enforcement

SMPL Social LLC reserves the right to monitor platform activity for security, moderation, compliance, operational, analytical, fraud prevention, infrastructure management, and enforcement purposes.

We may remove content, restrict features, suspend accounts, terminate access, or enforce platform limitations at our sole discretion.

  1. . Data and Privacy

The Services may integrate with or rely upon third-party platforms, providers, APIs, cloud infrastructure, payment processors, storage systems, or external services.

SMPL Social LLC is not responsible for third-party availability, systems, actions, policies, outages, data handling practices, pricing, interruptions, or content.

  1. Third-Party Services

Your use of the Services is also governed by our Privacy Policy. By using the Services, you consent to the collection, storage, processing, analysis, and use of data as described within the Privacy Policy.

  1. . Force Majeure

SMPL Social LLC shall not be liable for delays, interruptions, failures, or inability to perform caused by events beyond our reasonable control, including but not limited to natural disasters, cyberattacks, cloud provider outages, internet failures, infrastructure interruptions, governmental actions, labor disputes, wars, terrorism, power outages, or third-party service failures.

  1. . Anti-Resale and Competitive Use Restrictions

Users may not reproduce, replicate, scrape, benchmark, sublicense, distribute, commercially exploit, reverse engineer, train competing systems with, or otherwise use the Services, infrastructure, outputs, workflows, or systems for the purpose of creating competing products or services without prior written authorization from SMPL Social LLC.

Unauthorized commercial exploitation of the Services is strictly prohibited.

  1. . Limitation of Liability

To the fullest extent permitted by law, SMPL Social LLC shall not be liable for any indirect, incidental, consequential, punitive, exemplary, or special damages, including but not limited to loss of profits, revenue, goodwill, data, business opportunities, or service interruptions.

The Services are provided on an “as is” and “as available” basis without warranties of any kind, whether express or implied.

Your use of the Services is entirely at your own risk.

  1. . Limitation of Damages

To the maximum extent permitted by law, the total cumulative liability of SMPL Social LLC arising out of or relating to the Services, these Terms, or any claim by a user shall not exceed the total amount paid by the user to SMPL Social LLC during the twelve (12) months preceding the event giving rise to the claim.

You agree to indemnify, defend, and hold harmless SMPL Social LLC, its owners, affiliates, employees, contractors, partners, successors, and representatives from and against any claims, liabilities, damages, losses, expenses, or legal fees arising from your use of the Services, generated content, violation of these Terms, infringement of rights, or misuse of the platform.

Termination does not limit any other rights or remedies available to SMPL Social LLC.

SMPL Social LLC reserves the right to update, modify, revise, or replace these Terms at any time. Continued use of the Services after changes become effective constitutes acceptance of the updated Terms.

Whenever referenced throughout these Terms, actions taken “at our sole discretion” shall mean that SMPL Social LLC retains the unrestricted right to make decisions regarding moderation, enforcement, platform access, restrictions, refunds, pricing, feature availability, usage limitations, account suspensions, content removal, or operational policies without obligation to provide explanation or advance notice.

Any disputes arising out of or relating to these Terms or the Services shall be resolved through binding arbitration conducted on an individual basis and not in court proceedings.

You waive any right to participate in class-action lawsuits, representative actions, class-wide arbitration, or collective proceedings.
